How do I go about registering my Trade Mark?
When you apply to register your trade mark, you should
either be using the mark yourself (or consenting to a third party using
it) or should have a genuine intention to use the mark in the future
(or be consenting to a third party using it in the future).
Your application should be filed, together with the
appropriate official fee, at the Trade Marks Registry. You must identify
the mark, the goods or services of interest, your name and address and
you must state whether you are using or intend to use the mark. Provided
all this has been done, your application will be given a filing number
and date.

Within 1-3 months of the filing date,
the Registrar of Trade Marks should examine your application. They will
check that there are no prior existing similar marks and that your mark
is essentially registrable. If they raise any objections, these can be
contested and if you are successful your application will then be published
in the Official Trade Marks Journal to give other parties the opportunity
to object to your mark. Provided there are no objections, your mark will
then proceed to registration. Any objections must obviously be dealt with
before your mark can be registered. Your rights will be effective from
the date on which you made your application.
