What is a Patent?

A patent is a right to the exclusive use of an invention. However, a patent does not give the inventor the automatic right to exploit his invention. This is because his invention may not be brand new but may be a development of an earlier patented invention. In this case he would have to buy a licence under the earlier patent before he could exploit his own invention.

A UK patent can last for a maximum of 20 years.

 

What rights would a patent give me?

A patent would give you the exclusive right to use your invention or to let other people use your invention under terms agreed by yourself. You will also have the right to take legal action against anyone who uses your invention without your permission and to claim damages from them.

For what can I obtain a patent?

Not all inventions are patentable. Your invention must be capable of being used within industry (including agriculture) and must not consist solely of a scientific theory, mathematical method, an artistic or aesthetic work, a business scheme, or a purely mental act. In addition, there are certain other invention categories that are specifically excluded from being patentable.
