What is a "design"?

When we are talking about the "Design" of an article, we are referring to its physical appearance as opposed to the way the article is actually constructed. By this, we mean the way it is shaped or decorated.

Why might I want to protect the design of an article?

You may want to protect the design of an article where it is the actual physical appearance which is its selling point. Design protection can also be used in addition to other forms of protection such as trade mark and patent, especially in circumstances where those other forms would not be applicable.

How do I protect my design?

There are two forms of protection for your design in the UK, Design Right which is similar to copyright and occurs automatically and Registered Design protection which like most other forms of protection has to be applied for but will give you more comprehensive cover.
